1. Legal framework and scope

These Terms & Conditions (the "Terms") govern all purchases made on the Apex Fit website (https://apexfitmen.com) and form a legally binding agreement between the consumer ("you") and KAL ECOMMERCE UK LTD ("we", "us" or "our").

These Terms are established in accordance with: the UK Consumer Rights Act 2015, the UK Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013, EU Directive 2011/83/EU on consumer rights (for consumers based in the EU), the Electronic Commerce (EC Directive) Regulations 2002, and applicable international trade and data protection laws.

3. Acceptance of terms

By accessing the website and/or placing an order, you acknowledge that you have read, understood and accepted these Terms in full. These Terms prevail over any other general or specific conditions not expressly accepted by us. We reserve the right to amend them at any time. Any amendment will be published on the website and will apply only to subsequent orders.

4. Eligibility to purchase

To place an order, you must be at least 18 years old or have the legal capacity required by your local law, and provide accurate, complete and up-to-date personal information, including a valid delivery address and a means of payment. We reserve the right to refuse or cancel any order in the event of fraud, breach of these Terms, or for any legitimate reason at our sole discretion.

5. Products and availability

All products offered for sale are described and presented as accurately as possible. However, we do not guarantee that product descriptions or any other content on the site are accurate, complete or error-free. Products are available while stocks last. If a product becomes unavailable after an order has been placed, the customer will be informed and refunded within 14 working days. We reserve the right to withdraw any product from sale at any time.

6. Prices and payment

All prices are shown in the currency corresponding to your region and include applicable VAT unless stated otherwise. Prices may change without notice but are guaranteed at the time of order confirmation. Payment must be made in full at the time of order through secure payment providers (Visa, Mastercard and other methods available at checkout). We do not store your payment details and use encryption technology to secure transactions.

7. Order confirmation

Once your order is placed, you will receive an automatic confirmation email. This email constitutes an acknowledgement of receipt, but not yet final acceptance of your order. If you do not receive this email within 24 hours, please check your spam folder or contact us at info@apexfitmen.com.

8. Processing, shipping and delivery

Estimated delivery times (excluding processing):

Deliveries are made on working days only. Delays may occur during holiday periods or in cases of force majeure. We work with several third-party carriers and are not responsible for delays once the parcel is in transit.

9. Right of withdrawal (UK and EU consumers)

In accordance with the UK Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013 and EU Directive 2011/83/EU, consumers based in the UK and the EU have the right to withdraw within 14 days from the date of delivery, without having to justify their decision. Products must be returned unused, in their original condition and packaging. Return and refund terms are set out in our Return Policy and Refund Policy.

10. Returns, exchanges and refunds

Any request must be sent by email to info@apexfitmen.com with your full name, order number and clear photographic evidence where applicable. Returns for dissatisfaction or voluntary exchanges are accepted under the conditions set out in our policies. Products must be returned at the customer's expense, except in the event of an error or defect attributable to Apex Fit. Defective or incorrect products will be replaced or refunded in accordance with consumer protection laws.

11. Risk and transfer of ownership

Products remain our property until full payment has been received. The risk of loss or damage passes to the customer upon delivery. If a parcel is confirmed lost by the carrier, we will offer a replacement or a full refund.

12. Customer responsibilities

Customers are responsible for providing accurate delivery addresses. We cannot be held responsible for parcels that are not delivered due to incorrect or incomplete information. No refund or re-shipment will be made if the order has already been shipped.

13. Intellectual property

All elements of the site (text, images, logos, designs, graphics, etc.) are the intellectual property of KAL ECOMMERCE UK LTD and are protected by copyright and trademark law. Any unauthorised use or reproduction is strictly prohibited and may give rise to legal action.

14. Data protection

We collect and process your personal data in accordance with the UK Data Protection Act 2018 and the UK GDPR (and the EU GDPR where applicable). For more information, please see our Privacy Policy.

15. Limitation of liability

To the extent permitted by law, we cannot be held liable for any indirect, incidental or consequential damages arising from the use of the site or the products purchased, including but not limited to loss of profits, business interruption or loss of data.

16. Force majeure

We cannot be held liable for any failure or delay in performing our obligations due to causes beyond our control, including natural disasters, government decisions, industrial action or supply chain disruptions.

17. Governing law and jurisdiction

These Terms are governed by the laws of England and Wales. In the event of a dispute, the competent courts of London, United Kingdom, shall have exclusive jurisdiction, subject to any mandatory protective provisions applicable in your country of residence.
